Health Insurance After Divorce or Separation
If your coverage came through your spouse's job, a divorce ends it. The timing is set by the plan and the decree, not by you, so the sooner you know your options the smoother it goes.
When the coverage ends
Usually the end of the month the divorce is final, sometimes the day of. The employer's HR department will tell you the exact date. Legal separation alone may or may not end coverage depending on the plan.
Your options
- COBRA from the ex-spouse's employer. Divorce is a COBRA qualifying event, and you can keep that plan for up to 36 months at full price. Expensive, but it keeps your doctors and any deductible you have met this year.
- Marketplace plan. Losing coverage opens a 60-day special enrollment period. Your subsidy is now based on your own household income, which after a divorce is often lower, so many people qualify for meaningful help for the first time.
- Private PPO plan. If you are healthy and your income is above the subsidy range, a private plan priced on health rather than income is often the cheapest real coverage and can start any month.
Kids
Children usually stay on whichever parent's plan the decree assigns. If that parent has no employer plan, a marketplace plan for the kids often qualifies for a subsidy or CHIP, or they go on a private family plan where child rates are low. I set up split arrangements between households routinely.
Income you report
Alimony received under agreements made after 2018 is not taxable income, which affects your marketplace estimate. Child support is not income either. Get this right or the subsidy will be wrong.
Do not go bare while the paperwork settles
Divorce timelines slip. Pick a plan start date that touches the end of the old coverage. If the decree moves, we adjust.
Frequently asked questions
How long do I have to get new coverage after a divorce?
60 days from the day coverage ends for a marketplace special enrollment period. COBRA election is also 60 days from the notice. Private plans have no window.
Can I stay on my ex's plan?
Only through COBRA, for up to 36 months, paying the full premium yourself. Some decrees require the employee spouse to cover that cost; check yours.
Does alimony count toward a marketplace subsidy?
For agreements finalized after 2018, alimony received is not taxable and does not count. Older agreements may differ. Confirm with your CPA.
What if I have a health condition?
Then the marketplace special enrollment is your guaranteed path. I enroll clients there at no cost.
